Terms of Use

These Terms of Service (“Terms”) and all Policies listed govern and apply to your use of the free and paid services, software and websites provided by Stream Solutions LLC DBA StreamRX.

By using the Service, you agree to be bound by these Terms and our Privacy Policy. If you’re using our Service on behalf of an organization or entity (“Organization”), then you are agreeing to these Terms on behalf of that Organization and you represent and warrant that you have the authority to bind the Organization to these Terms. In that case, “you” and “your” refers to that Organization.

1. Your User Account and Content

• You must provide accurate information when you create your StreamRX account.
• You are responsible for safeguarding the password and for all activities that occur under your account.
• You may not disassemble, decompile, or reverse engineer the Service.
• Accounts registered by "bots" or other automated methods are not permitted. You must be 13 years of age or older.
• For paid accounts, all fees are non-refundable. All sales are final.

2. Your Use of Our Service

You must not change, modify, adapt, or alter the Service or falsely imply that another website is associated with the Service. You must not interfere or disrupt the Service or servers or networks connected to the Service, including by transmitting any worms, viruses, spyware, malware, or any other code of a destructive or disruptive nature.

So long as you comply with these Terms, we grant you a limited, nonexclusive, nontransferable, revocable license to use the Software, solely to access the Service.

3. General Conditions

We may suspend or terminate your account(s) at any time without liability to you for any reason, including if we reasonably believe you have violated these Terms or create risk for us.

We reserve the right, in our sole discretion, to change these Terms and/or our Services offered from time to time (“Updated Terms”). Your use of the Service after the effective date of the Updated Terms constitutes your agreement to the Updated Terms.

StreamRX, MedicareView, TierPlus and Stream Solutions LLC names and logos are our proprietary marks and may not be copied, imitated, or used, in whole or in part, without our prior written permission.

4. TierPlus & Data Accuracy

TierPlus provides tier data information that is sourced directly from the Centers for Medicare & Medicaid Services (CMS). While TierPlus strives to present the most current and accurate information available, we cannot guarantee the real-time accuracy of the data. Discrepancies may exist between TierPlus displays and the official medicare.gov website. Users should always verify critical information directly with CMS or medicare.gov. StreamRX shall not be held responsible for any decisions made based on TierPlus data.

5. Ownership & Rights

All materials contained on or within the Services, including text, graphics, images, code, and designs are protected by copyright, trademark, and other intellectual property laws.

We claim no ownership rights over the Content submitted or created exclusively by you in your StreamRX account. Any Content that is yours remains yours.

6. Disclaimer of Warranties

THE SERVICE, INCLUDING, WITHOUT LIMITATION, OUR CONTENT, IS PROVIDED ON AN "AS IS", "AS AVAILABLE", AND "WITH ALL FAULTS" BASIS. THE StreamRX PARTIES HEREBY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, CUSTOM, TRADE, QUIET ENJOYMENT, SYSTEM INTEGRATION, AND FREEDOM FROM COMPUTER VIRUS.

7. Limitation of Liability

UNDER NO CIRCUMSTANCES WILL THE STREAMRX PARTIES BE LIABLE TO YOU FOR ANY LOSS OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, ECONOMIC, EXEMPLARY, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL LOSSES) THAT ARE DIRECTLY OR INDIRECTLY RELATED TO THE SERVICE. IN NO EVENT WILL THE StreamRX PARTIES TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED UNITED STATES DOLLARS ($100.00).
